The following general conditions of sale govern the contract for the marketing of the products offered to its customers through the site www.scarpabaleno.it by “SCARPABALENO” owned by Ro.Ma. srl with headquarters in Piazza Pietro Merolli n ° 7, 00151 Rome, P.I. 05775571002
The website displays the availability of each product in real time. If the product is not available at the moment, the customer can request information on the timing of restocking via the following e-mail address: email@example.com or by calling 06/79783463.
In case there is an error in the availability of the product, delays or impossibility in its restocking, “SCARPABALENO” will promptly notify the customer by e-mail or by telephone to find a suitable solution to the problem.
*Orders and Prices:
The customer will have the opportunity to view the products and their characteristics that are provided directly by the producers of the goods themselves and / or by third parties specialized in the preparation of the product data sheets. It is possible to view the photographs published for the sole purpose of illustrating the products by way of example.
The price displayed on the site is expressed in Euro including VAT, not including transport fees and any services requested. “SCARPABALENO” reserves the right to modify at any time, at its sole discretion and without notice, the price of the products and / or services on the site. The price of the products on the site is a price reserved exclusively for online purchases and, as such, must be managed exclusively on the web platform. In no case is it possible to take advantage of the same conditions of sale between the website and the point of sale which are two distinct entities. In the event of a purchase by a non-EU customer, the VAT during the transaction will be separated. For this reason, “SCARPABALENO” is not responsible for any fraudulent or illegal use that may be made by third parties of credit cards and other means of payment upon payment of the products purchased on its site.
Bank Transfer: By making a request during the purchase procedure, “SCARPABALENO” will send the necessary data to complete the transaction. For this form of payment, the order will be processed at the time of the actual crediting of the paid amount which can normally vary from 3 to 7 working days. *Delivery of the order:
“SCARPABALENO” makes shipments all over the world relying on various express couriers, in order to offer the customer a better service by obtaining advantageous rates. Once the payment has been verified, “SCARPABALENO” will prepare the order and, as soon as the goods are entrusted to the courier, will notify the customer of the shipment by e-mail or by telephone.
Any duties and taxes applied by foreign countries are the sole responsibility of the customer.
“SCARPABALENO” cannot be responsible for errors and / or non-delivery of the order due to
inaccuracy or incompleteness of the form reserved for data relating to the shipment by the Customer.
“SCARPABALENO” will not be responsible for delays in the collection, transport or delivery of any item regardless of the cause of the delay. Furthermore, “SCARPABALENO” will not be responsible for loss, incorrect or non-delivery due to force majeure, fortuitous events and any other reason reasonably not attributable to “SCARPABALENO”.
“SCARPABALENO” will in no case be held responsible for any direct and / or indirect damage and / or loss of any kind, however determined, that the Customer should suffer regardless of whether “SCARPABALENO” was aware or not that such damages could have been caused. By way of example, but not limited to, indirect damages and losses mean: loss of earnings, profits, goodwill, customers, damage to image. Ect .. Without prejudice to the exclusion of liability of “SCARPABALENO” for indirect damage, the Customer is entitled to stipulate in his favor and at his expense a special insurance guarantee to cover damage resulting from transport. It is understood that in the absence of insurance coverage, all the aforementioned damages will be directly assumed by the Customer on his own, given the aforementioned exclusion of “SCARPABALENO” responsibility.
Notwithstanding articles 1686 and 1690 of the Italian Civil Code in the event that the transport cannot be carried out, “SCARPABALENO” will notify the customer to find an adequate solution to solve the problem. In the absence of timely instructions, “SCARPABALENO” will treat the items in storage for 14 days without however assuming any responsibility for their conservation.
The Customer can also collect his purchase directly from the shop located in Piazza Pietro Merolli
n° 7 – 00151 Rome, upon appointment agreed by e-mail, exclusively on the days and during the opening hours of the store. To collect the order, the Customer must indicate the order number and a valid identity document. It is also possible to delegate a third person to collect the order but the Customer must notify “SCARPABALENO” in advance by e-mail firstname.lastname@example.org indicating the personal details of the person responsible for the collection. The delegate will be able to collect the order only if equipped with a written proxy signed by the Customer and a valid identity document.
*Rights and Duties of the Customer:
The Customer is solely responsible for the truthfulness and accuracy of the information and data provided to “SCARPABALENO” so it is forbidden to enter false and / or fictional data in the registration and order phase. The Customer also undertakes to communicate any changes thereof.
The Customer declares in the act of confirming the purchase that he has read, understood and accepted the General Conditions of Sale, to authorize “SCARPABALENO” to process the personal data communicated at the time of purchase.
Upon delivery of the order, the Customer must check:

*Right of withdrawal:
The right of withdrawal, as per law, applies only and exclusively if the customer qualifies as a “consumer”, or rather as the natural person acting for purposes unrelated to business, commercial, craft or professional activity.
The customer can take advantage of the right of withdrawal without any penalty without specifying the reason, no later than fourteen days from receipt of the goods purchased.
To exercise the right of withdrawal, the Customer must send a written communication by e-mail to the following address email@example.com indicating the order identification number and specifying for which products he wishes to exercise the right of withdrawal.
While exercising the right of withdrawal, the Customer will have to bear the full costs of returning the purchased products both if the product has already been delivered, and if, as a result of the shipment that has already taken place, it will be delivered to the customer after exercising the withdrawal.
The deadline for returning the product is fourteen days from the notice of withdrawal. For the Customer who can take advantage of the right of withdrawal, “SCARPABALENO” will refund the amount paid by the Customer with the exception of the direct cost of returning the product which is always and in any case charged to the Customer.
